Just when you thought it was over, the infamous fencegate returns to headlines.
This time the ‘neighbours at war’ feud is going to the High Court after the Wellington City Council decided to appeal the Environment Court decision.
As a brief recap, the Aitchisons’ neighbour constructed a fence-esque structure along the border between the two properties which obscured the Aitchisons’ views.
After a prolonged battle in the courts and papers the fence was ordered to be removed and costs were ordered in favour of the Aitchisons.
The Wellington City Council is appealing the decision on the basis that it will have far reaching implications for the residents of Wellington.
The Council’s lawyer made it clear that they were not challenging the acceptability of what was built on the Roseneath property.
