$25.07 million awarded in the biggest leaky building case to date

The owners of a leaky apartment building have been awarded $25.07 million in a judgment released on Wednesday. Topping the chart as the highest damages yet to be awarded for a leaky building claim, this sum is likely to be borne initially by the Auckland Council. The Council may then pursue the other parties for contribution: the builder Brookfield Multiplex Constructions (NZ), Walker Architects, Façade Technologies, Charles Norager and Sons and Brookfield’s insurer Zurich Insurance.

With the Council and Charles Norager and Sons the only solvent defendants, the extent of the Council’s recovery remains unclear.
